Genetically Modified Organisms (GMO): The Legality In Kenya
"In accordance with the Task Force to Review Matters Relating to Genetically Modified Foods and Food Safety's recommendation and in accordance with the National Biosafety Authority's guidelines on all applicable international treaties, including the Cartagena Protocol on Biosafety (CPB), Cabinet vacated its earlier decision of November 8, 2012, prohibiting the open cultivation of genetically modified crops and the importation of food crops and animal feed products.'' The communiqué from the October 3 Cabinet meeting stated, "By virtue of the presidential order, open growing and importing of white (GMO) maize is now authorized."
On October 3, 2022, President Ruto presided over a meeting in the State House when members of the Uhuru Cabinet convened to discuss the adoption of GMO foods. On October 27, the Ruto Cabinet was sworn in.
Martha Karua, the head of NARC Kenya, claims that it was unlawful for President William Ruto to have used the old Uhuru Kenyatta cabinet to authorize GMOs. "Once a new president is sworn in following elections, the previous administration's rule ends and its cabinet is legally disbanded. After Uhuru's inauguration, there were no such things as the alleged cabinet meetings. GMO decisions are invalid since they amount to little more than a roadside proclamation," Ms. Karua remarked.
Let the constitutional attorneys assist us in understanding how the public interest swung on this matter. Regardless of how GMO may be, the law should be followed. We are not in hurry to die, even though we are death candidates as remarked by CS Kuria.
